Biden DOJ reverses the Trump-era place

The Justice Department informed the Supreme Court on Wednesday that it no longer considers Obamacare to be unconstitutional. This is the last reversal of the department since President Joe Biden’s inauguration in January.

The Supreme Court is considering contesting Obamacare, officially known as the Affordable Care Act, filed by Texas and other Republican-led states. The Justice Department under former President Donald Trump supported Texas in legal pleadings and verbal disputes in November.

California and other blue states are defending the law that gave 20 million Americans health insurance.

“After the change in administration, the Department of Justice has rethought the government’s position in these cases,” wrote Edwin Kneedler, assistant attorney general, in a letter to Scott Harris, the clerk of the court.

The reversal of Biden’s Justice Department was expected. Biden played a role in the implementation of monumental legislation by Congress in 2010 while serving as Vice President under then-President Barack Obama.

The case concerns Obamacare’s individual mandate provision that requires most Americans to purchase health insurance or pay a fine.

The Supreme Court previously upheld the individual mandate as lawful under the tax powers of Congress. After the Republicans in Congress set the penalty at $ 0 in 2017, Texas raised its challenge, arguing that the mandate was no longer a tax.

The Trump Justice Department agreed that the mandate was unconstitutional. The department also argued that if the Supreme Court scraps the individual mandate, it will have to scrap the entire Affordable Care Act.

Kneedler wrote that under Biden the Justice Department had reversed its position on both issues. The department, he wrote, believes the individual mandate determination is lawful and that the provision can be removed if the court does not find it while the rest of the law persists.

During the hearing in the case, it appeared unlikely that the judges would scrap the legislation entirely, although it was not clear whether a majority would find the individual mandate unlawful. Chief Justice John Roberts and Justice Brett Kavanaugh, both Conservatives, suggested they support the separation of individual mandate provisions from the rest of the sweeping law.

Kneedler, who has served in the Justice Department under the presidents of both major political parties for more than 40 years, wrote in the letter that the ministry had not attempted to file further briefs on the case. A decision is expected in the summer.

Biden declares coup sanctions in opposition to the army in Myanmar

President Joe Biden announced Wednesday that he would impose sanctions on military leaders in Myanmar who led the coup that ousted and detained leader-elect Aung San Suu Kyi, President Win Myint and others.

Biden also said the “Myanmar military must give up the power it has seized on February 1” and release its prisoners.

“We will set a first round of targets this week and we will also introduce strict export controls,” said Biden when announcing two new executive orders related to the sanctions.

The president said he would prevent Burmese generals from gaining access to $ 1 billion in Myanmar funds held in the United States.

Biden also said, “We are freezing US assets that benefit the Burmese government and continue to support health care, civil society groups and other areas that directly benefit the people of Burma.”

And he urged the military not to use force against protesters who are exercising their democratic rights to object to the coup.

Biden last week condemned the military takeover of the civilian-led government, describing it as a “direct attack on the country’s transition to democracy and the rule of law”.

When asked about the sanctions, State Department spokesman Ned Price later said, “We believe we can certainly impose significant costs on those responsible.”

“We can impose costs that are … even steeper” than previous sanctions against Myanmar, Price said.

When asked by a reporter why Biden’s announcement did not include an international reaction to the coup, Price suggested that such a reaction was imminent.

“When you hear more from our partners, it will be very clear that what we are bringing together will impose high and profound costs on those responsible for this coup,” Price said.

The National League for Democracy (NLD) of Nobel Prize winner Suu Kyi won the election in Myanmar in a landslide last November.

But the generals behind the coup have claimed the election was fraudulent.

Myanmar citizens, wearing red clothes that match the NLD color, took to the streets to protest the coup.

In response, the military banned rallies and gatherings of more than five people, as well as motorized processions, and imposed a curfew from 8 p.m. to 4 a.m. in Yangon and Mandalay, the country’s first and second largest cities.

The military also banned citizens’ use of the social media platforms Facebook, Twitter and Instagram “until further notice”.

The US officially eased previous sanctions against Myanmar in 2012 to allow US dollars to enter the country, while certain investments in the Myanmar Armed Forces and the Department of Defense were withheld

At the same time, the US retained the ability to increase sanctions against individuals and organizations who undermine the political reform process or are involved in human rights abuses.

Real estate developers have been grumbling lately, and we’re not talking about possible new cooling measures. It was about real estate agent commissions and how they have grown over the years.

In recent news, agents and market watchers report that URA has started wiping out feelers and investigating how developers are paying their real estate agents.

This is usually a prelude to a change, and here’s how it can affect you as a buyer:

How do developers currently pay real estate agents?

On paper, the commissions paid to brokers can be anywhere from two to three percent of the property price. Note that this is much higher than it used to be. In the late 1990s to early 2000s, commissions of one percent were considered high.

In practice, the commissions could sometimes be as high as seven or eight percent. This has been reported in the news even though commissions are not officially shown to the public (more on this below).

The higher commissions arise in the later start-up phases or when the development is shortly before the ABSD (Additional Buyers Stamp Duty) date.

Conversely, due to gray area referral programs and practices, commissions can sometimes be lower than the stated three percent.

We shouldn’t underestimate the impact of these commissions on the final price of a new starting property. A two percent commission for just 100 condos at $ 1.6 million each adds $ 3.2 million to development costs (and keep in mind that commissions can be closer to ABSD, or even higher for special units).

Note that the amount spent on commissions is not included in the total prices as the authorities don’t like it. This means that prices may be higher than what is shown in the data recorded.

How have the commissions increased to today’s level?

Real estate developers have five years to complete and sell their entire project. Otherwise, they’ll pay an additional Buyer Stamp Duty (ABSD) – 30 percent of the property price. This is independent of the size of the development or the number of units remaining.

If even a unit or two go unsold, the developer has to pay the whole tax. As a result, real estate agents often receive higher commissions to complete these urgent transactions. (Honestly this should really be scaled based on development size, this really penalizes big evolutions).

Of course, if the remaining units are difficult to move, the developers prefer to pay the eight percent commission on the sale rather than paying the ABSD.

In addition to the ABSD period, higher commissions can also be used to drive sales of high quantum units such as penthouses or units in a less desirable batch. This is of concern to buyers as it could lead to realtors pushing them to more expensive properties than their budget allows.

(Aside from that, this issue has been partially addressed by restricting new OTP issues. Buyers who couldn’t afford the down payment for these expensive units were often required to sign up with a promise that the OTP would be reissued by the time it was reissued they had sold their former home).

Tilray inventory rallies beneath a pot distribution settlement with Develop Pharma

Tilray shares rose 38.8% on Tuesday after the company signed an agreement with Grow Pharma to import and distribute its medical cannabis products in the UK.

Under the contract, Tilray will be able to make these products available to UK patients on prescriptions obtained through the country’s National Health Service or a general practitioner. The company expects these products to be available in the UK next month.

“This partnership with Grow Pharma provides patients in need with access to sustainable supplies of GMP-certified, high-quality medical cannabis and is an important step towards improving access in the UK,” said Brendan Kennedy, CEO of Tilray, in a statement.

Pierre van Weperen, CEO of Grow Pharma, also noted that the agreement will provide British patients with “safe and sustainable supply of the highest quality medical cannabis products”.

This deal is Tilray’s latest move to expand its market share in the cannabis space. In December, Tilray announced it would merge with Aphria in an all-stock deal to create the world’s largest cannabis company when the deal is closed.

To access it, make sure you have updated Zoom to the latest version of the app. This should be self-explanatory on your mobile devices. On the desktop, click your profile picture in the upper right corner of the main Zoom window and select Check for updates under the menu.
